Secretary of the Ministry of Justice of BiH and Deputy Director of Legal Department of the Ministry of Foreign Affairs of the People’s Republic of China, Mr. Xu Hong, have initialled today, in Beijing, Agreement on Extradition and Agreement on Legal Assistance in Civil and Commercial Matters. Agreements provide equal legal protection and access to courts on the territory of both countries and improve the process of extradition of persons who are wanted for initiating criminal procedure or for the enforcement of a sentence.
Agreement on Extradition determines the extraditable offences, grounds for refusal of extradition, refusal to extradite own nationals, provisional arrest, surrender of persons etc.
Agreement on Legal Assistance in Civil and Commercial Matters provides that citizens of one country have equal legal protection on the territory of the other country and have right to access courts under the same conditions provided for the citizens of the other country. This Agreement provides that legal assistance includes service of judicial documents, collecting of evidence and enforcement of court and arbitration decisions, as well as exchange of information on laws.
Mentioned agreements fully regulate legal cooperation in criminal, civil and commercial matters and final signing will follow after the completion of internal legislative procedures of the two countries.
